Terms of Service

Effective Date: March 12, 2026

§1 Acceptance of Terms

By downloading, installing, or using the TrackBite mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and TrackBite LLC, a California limited liability company ("TrackBite," "we," "us," or "our").

§2 Description of Service

TrackBite is a food truck and street vendor discovery platform that allows users to locate, track, and review food vendors. We provide a platform connecting consumers with food vendors; we are not a food service provider, vendor, or delivery service. We do not prepare, sell, or deliver food.

2.1 No Endorsement

TrackBite does not endorse, recommend, certify, or guarantee any vendor, business, listing, menu item, review, rating, or user content appearing on the Service. Any interactions you have with vendors or other users are solely between you and those parties.

§3 Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age;
  • You have the legal capacity to enter into a binding agreement;
  • You are not prohibited from using the Service under applicable law; and
  • Any registration information you provide is accurate and complete.

§4 Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration;
  • Maintain and promptly update your account information;
  • Keep your password confidential and not share it with third parties;
  • Notify us immediately of any unauthorized use of your account; and
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

§5 User Content

5.1 Your Content

You retain ownership of content you submit to the Service, including photos, reviews, and other materials ("User Content"). By submitting User Content, you grant TrackBite a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business operations.

5.2 Content Standards

You agree not to post User Content that:

  • Is false, misleading, or inaccurate;
  • Is defamatory, obscene, abusive, or offensive;
  • Violates any third party's intellectual property rights;
  • Contains personal information of others without consent;
  • Constitutes spam, advertising, or commercial solicitation; or
  • Violates any applicable law or regulation.

5.3 Content Removal

We reserve the right, but not the obligation, to remove any User Content that violates these Terms or that we find objectionable, in our sole discretion.

5.4 Ratings and Reviews Disclaimer

Ratings, percentages, reactions, or feedback displayed on the Service are user-generated or algorithmically derived and are provided for informational purposes only. TrackBite does not guarantee their accuracy, completeness, or representativeness.

§6 Location Data

The Service uses your device's location data to provide location-based features, including finding nearby food vendors. By enabling location services:

  • You consent to the collection and use of your location data as described in our Privacy Policy;
  • You understand that location data may be processed and stored on our servers;
  • You may disable location services at any time through your device settings, though doing so may limit Service functionality; and
  • We do not sell your precise location data to third parties.

§7 Prohibited Uses

You agree not to use the Service to:

  • Scrape, crawl, or otherwise extract data from the Service without our written permission;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Circumvent any security or access controls;
  • Interfere with or disrupt the Service or servers connected to the Service;
  • Use the Service for any unlawful purpose;
  • Impersonate any person or entity; or
  • Upload viruses, malware, or other harmful code.

§8 Intellectual Property

The Service and its original content, features, and functionality are owned by TrackBite LLC and are protected by United States and international intellectual property laws. Our trademarks, trade dress, logos, and service marks may not be used without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.

§9 Third-Party Links and Services

The Service may contain links to third-party websites or services, including but not limited to map services, social media platforms, and payment processors. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies.

§10 Disclaimers

10.1 Service Availability

We do not guarantee that the Service will be available at all times or without interruption. The Service may be unavailable from time to time for maintenance, upgrades, outages, network failures, security incidents, or other reasons beyond our control.

10.2 General Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRACKBITE DISCLAIMS ALL WARRANTIES, INCLUDING:
  • Any warranty that the Service will be uninterrupted, error-free, or free of viruses;
  • Any warranty regarding the accuracy, reliability, or completeness of vendor information, locations, hours, or menu items;
  • Any warranty regarding food quality, safety, or compliance with health codes; and
  • Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

TrackBite is a discovery platform only. We do not verify vendor permits, licenses, food safety certifications, or the accuracy of vendor-provided information. Users interact with vendors at their own risk.

§11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRACKBITE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO:
  • Your access to or use of (or inability to access or use) the Service;
  • Any conduct or content of any third party, including vendors, on the Service;
  • Any food consumed based on information discovered through the Service; or
  • Unauthorized access, use, or alteration of your transmissions or content.
IN NO EVENT SHALL TRACKBITE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

§12 Indemnification

You agree to indemnify, defend, and hold harmless TrackBite LLC and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

§13 Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@trackbite.io and attempt to resolve the dispute informally for at least thirty (30) days.

13.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may bring claims in small claims court if they qualify. The arbitration shall take place in San Francisco, California, or by video conference.

13.3 Class Action Waiver

YOU AND TRACKBITE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

§14 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in San Francisco County, California.

§15 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Effective Date" at the top of this page and, where appropriate, by in-app notification. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

§16 Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

§17 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and share information about you when you use the Service, including location data and authentication information processed through Firebase.
